Under Virginia law, amateur poker games held in private homes — even when playing for money — are not illegal.A card game becomes illegal when it is held regularly by an "operator" who takes a percentage of the pot. An operator includes any person, firm or association of people who conducts, finances, manages, supervises, directs of owns all or part of a gambling operation.
Internet gambling is also illegal under the Code of Virginia.
The penalty for participating in an illegal card game is a Class 3 misdemeanor, which carries a maximum $500 fine. Running an illegal gambling operation is a Class 6 felony and carries a maximum of 5 years imprisonment.
